1. Acceptance of Terms

By accessing, browsing, or using the Densy AI platform, including our voice, SMS, chat, and social media AI agents (collectively, the "Services"), you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our Services.

These terms apply to all visitors, users, and others who access the Services. If you are opening an account on behalf of a company, organization, or other entity, then "you" includes you and that entity, and you represent and warrant that you are authorized to grant all permissions and licenses provided in these Terms and bind the entity to these Terms.

2. Description of Services

Densy AI provides automated communication tools designed to handle inbound and outbound interactions across various channels. The platform enables businesses to configure AI agents that engage with customers via telephony networks, SMS gateways, web chat interfaces, and supported social media integrations.

You understand and acknowledge that the AI agents operate based on parameters, scripts, and configurations set by you. Densy AI relies on third-party integrations and network providers to deliver these communications. As such, we cannot guarantee uninterrupted or error-free transmission across all channels at all times.

3. Account Registration & Security

To use the majority of our Services, you must register for an account. When you register, you agree to provide accurate, current, and complete information. You are responsible for safeguarding your login credentials and for any activities or actions under your account, whether or not you have authorized such activities.

You agree to notify Densy AI immediately of any unauthorized use of your account or any other breach of security. Densy AI cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.

4. Acceptable Use Policy

When configuring AI agents or using Densy AI's communication infrastructure, you agree to comply with all applicable local, state, national, and international laws, including but not limited to the Telephone Consumer Protection Act (TCPA) in the United States and similar regulations globally.

You agree not to use the Services to:

  • Send unsolicited or unauthorized advertising, promotional materials, or "spam" messages.
  • Initiate outbound calls or messages to individuals who have opted out or are registered on "Do Not Call" lists without appropriate legal exemptions.
  • Transmit any material that is deceptive, fraudulent, defamatory, obscene, or otherwise objectionable.
  • Impersonate any person or entity without their explicit consent, or misrepresent your affiliation with a person or entity.
  • Interfere with or disrupt the integrity or performance of the Services or third-party data contained therein.

5. Intellectual Property

All rights, title, and interest in and to the Services, including all underlying software, algorithms, user interfaces, documentation, and materials provided by Densy AI, are and will remain the exclusive property of Densy AI and its licensors.

You retain all rights to your customer data and the specific conversational scripts you configure within the platform. By utilizing the Services, you grant Densy AI a worldwide, non-exclusive license to host, copy, transmit, and display your data solely as necessary for us to provide the Services to you.

6. Limitation of Liability

In no event shall Densy AI, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Services.
  • Any conduct or content of any third party on the Services.
  • Missed communications, delayed responses, or errors generated by your configured AI agents.
  • Unauthorized access, use, or alteration of your transmissions or content.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date at the top of this document. We may also notify you via email or through a notification in your account dashboard.

By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.
